General Terms and Conditions (GTC)
for Novus Concierge

1. Scope of application
These General Terms and Conditions apply to all services, offers, and contracts between Novus Concierge (hereinafter referred to as the “Provider”) and customers worldwide.
Any deviating terms and conditions of the customer shall not apply unless they have been expressly agreed in writing.
By using our services, making an inquiry, or placing a booking, the customer accepts these GTC.
2. Scope of services
Novus Concierge offers high-quality and exclusive luxury concierge services, including:
• VIP and premium concierge
• Exclusive reservations and organization (restaurants, events, travel, clubs, etc.)
• Lifestyle and assistance services
• Errands, bookings, arrangements
• Individual customer requests on request
The specific scope of services is determined by the respective agreement between the provider and the customer.
The provider reserves the right to reject requests if they:
• violate applicable law
• are ethically or safety-relevant
• are impossible to implement
3. Conclusion of contract
1. All offers are subject to change and non-binding.
2. A contract is concluded when the customer requests a service and the provider confirms this in writing or electronically — or when the provider begins to provide the service.
3. Individual agreements take precedence over these General Terms and Conditions.
4. Prices & Terms of Payment
1. All prices are quoted in euros (EUR).
2. Remuneration is based on individually agreed flat rates, hourly rates, or expense rates.
3. The provider accepts all common payment methods, including:
o Credit card
o PayPal
o Stripe
o SEPA bank transfer
4. Payments are due immediately upon invoicing, unless otherwise agreed.
5. For orders with high external costs (e.g., tickets, reservations, travel), advance payment may be required.
5. Cancellations & refunds
1. Cancellations, refunds, and rebookings are subject to individually agreed terms between the provider and the customer.
2. Services already rendered, expenses or external costs are generally non-refundable.
3. External services (e.g. hotels, tickets, flights) are subject to the respective terms and conditions of the third-party providers.
4. The customer shall bear all costs incurred as a result of their cancellation or a service not used, unless otherwise agreed.
6. Obligations of the customer
The customer undertakes:
• to provide correct, complete, and up-to-date information
• to make agreed payments on time
• not to make any unlawful demands
• to give the provider access to all relevant information necessary for the performance of the services
7. Liability
1. The provider is only liable for damages caused by intentional or grossly negligent behavior.
2. In cases of slight negligence, the provider is only liable for breaches of essential contractual obligations.
3. Liability is limited—to the extent permitted by law—to foreseeable damages typical for this type of contract.
4. No liability exists for:
o Failures, errors, or delays caused by third-party providers
o Lost data, lost profits, or indirect damages
o Events of force majeure
5. The provider is not responsible for the quality, fulfillment, or availability of third-party services arranged by it.
8. Arrangement of third-party services
When Novus Concierge arranges third-party services (hotels, events, clubs, flights, restaurants, etc.):
• the contract is concluded directly between the customer and the third-party provider
• the terms and conditions of the third-party provider apply exclusively
• Novus Concierge accepts no liability for their services
9. Confidentiality & data protection
The provider treats all customer information as strictly confidential.
Personal data is processed in accordance with the provider's privacy policy.
10. Intellectual property
All content, text, images, logos, data, and concepts belonging to Novus Concierge are protected by copyright and may not be used without express written permission.
11. International use
The provider offers its services worldwide.
The customer is responsible for ensuring that their requirements and bookings are legally permissible in the respective country.
12. Applicable law & place of jurisdiction
1. The law of the Federal Republic of Germany applies.
2. For entrepreneurs, the place of jurisdiction is the provider's registered office.
3. For consumers, the mandatory consumer protection laws of their country of residence also apply.
13. Changes to these terms and conditions
The provider may change these terms and conditions at any time.
The current version published on the website shall always apply.
